By using the Site, you agree to the terms of this Privacy Policy. If you do not agree, please discontinue use of the Site.

1. Information We Collect

Device and usage information. When you visit the Site, we automatically collect certain information about your device, including your web browser, IP address, general location (city/region level), time zone, and how you interact with the Site (pages viewed, referring website, and search terms used to find us). We refer to this as "Device Information."

Information you provide directly. We collect personal information you choose to share with us, which may include:

  • Name, phone number, and email address (consultation requests, contact forms, WhatsApp)

  • Mailing or project address (for design consultations and proposals)

  • Project details and design preferences you share with us

  • Payment-related information when you make a payment (see Section 5)

  • Photos of your project, submitted by you or taken by us during the course of a design or installation project (subject to the terms of your signed design agreement)

Information from third parties. We may receive limited information about you from lead-generation platforms you use to contact us (such as Thumbtack, Houzz, or Google Business Profile), consistent with those platforms' own privacy policies.

2. Cookies and Advertising Technologies

We use cookies and similar tracking technologies, including the Meta (Facebook/Instagram) Pixel and Google Ads conversion tracking, to understand how visitors use our Site, measure the performance of our advertising campaigns, and show relevant ads to people who may be interested in our services. These tools may collect information about your visit to our Site and other websites for advertising and analytics purposes.

You can control cookies through your browser settings. Note that disabling cookies may affect how the Site functions. You may also manage ad personalization directly through your Google or Meta account settings.

3. How We Use Your Information

We use the information we collect to:

  • Respond to consultation requests and provide design proposals

  • Communicate with you about your project, including by phone, email, text/SMS, and WhatsApp

  • Detect and prevent fraud or misuse of our Site

  • Comply with legal obligations

4. Portfolio and Marketing Use of Project Photos

Where you have signed a design agreement with Element Design FL that authorizes it, we may use before, during, and after photos of your project — along with related 3D concept renderings — in our portfolio, website, social media, and other marketing materials. We do not publish your home address or other personally identifying contact information alongside these photos without your separate written consent.

5. Payment Information

When you make a payment to Element Design FL (by Zelle, check, credit card, or bank transfer), we collect the information necessary to process and record that payment. We do not store full credit card numbers on our systems; card payments are processed through our third-party payment processor, which maintains its own security and privacy practices.

These providers only receive the information necessary to perform their services and are not authorized to use your information for their own independent purposes.

We do not sell your personal information.

7. Your Rights

If you are a resident of the European Economic Area (EEA), you have rights under the GDPR, including the right to access, correct, delete, or restrict the use of your personal information, and the right to data portability and to object to certain processing.

If you are a resident of the United States, you may also contact us to request access to, correction of, or deletion of your personal information, and we will respond consistent with applicable law.
